Steps to take when filing for workers’ compensation

If you suffer an on-the-job injury or discover a work-related illness, you must report it to your employer immediately. You must also let your union representative know right away or call the Bureau of Workers’ Compensation. By reporting your injury within 21 days of occurrence, you can receive compensation that begins with the day of your injury.

You can still qualify for workers’ compensation if you wait up to 120 days to report injuries. However, if you wait, your compensation begins from the date that you reported it, rather than the date when you suffered injury. Unless you suffer from a progressive disease, you cannot receive compensation for illness or injuries reported after 120 days, which is why it is important to act quickly.

Be sure to seek immediate medical attention and keep records of bills, doctor reports, and other medical documentation.

Your employer must immediately report your injury to the insurance carrier or to the person who manages the workers’ compensation program if self-insured. Employers have 48 hours to file a First Report of Injury with the Bureau of Workers’ Compensation. Within 21 days, you should either start receiving some type of payment or a denial of your claim.

A workers’ compensation attorney can help you with filing to make sure you receive the right type of workers’ compensation. A lawyer can also help with handling a denied claim or working on a delayed claim, and can assist with re-opening a claim you have been told is closed by the insurance company, but which may not in fact be closed.
