LEGISLATIVE ALERT HOUSE BILL 808- Extends Panel Medical From 90 to 180 Days

We have gotten calls from many of our medical providers about House Bill 808, which would extend care of a panel doctor from 90 days to 180 days. This is obviously the insurance companies’ version of rationed medical care and a way to control injured workers’ lives.

Prior to the Bill being introduced, and since the Bill has been in committee, our Firm has been working to defeat the Bill. In my position as Treasurer of the Philadelphia Trial Lawyers PAC (Committee for a Better Tomorrow or CBT), Jerry’s position as the Past Chair of the Workers’ Compensation Section for the Pennsylvania Association of Justice (PAJ) and in his position as Vice President of PAJ, as well as Dave Stern’s current position as the Chair of the Work Comp Section of PAJ, we have had numerous conference calls with our leadership and lobbyists as well as communications with legislators.

The Legislature will not be in session this week, but the Bill will have a second consideration on Monday, May 23rd. We have 16 Amendments that have been filed that have to be debated when the Bill is again discussed.

We have formed a coalition with the AFL/CIO and other labor organizations, as well as the Pennsylvania Orthopedic Society and the Pennsylvania Chiropractic Association, all of which have taken the position AGAINST this Bill. Regrettably, as of this date, the Pennsylvania Medical Society has not taken a position and we hope to hear from their lobbyist, Scott Chadwick, on Monday May 16th if they will oppose the Bill. I would suggest that each and every one of you contact the Pennsylvania Medical Society, especially primary care physicians, to oppose the Bill.

In the meantime, below is a link to a list of House Republicans that we need you to contact. If any of you have your practice or live in one of these House Members’ Districts, please call immediately. We are providing you with the direct office numbers. We are only giving you the list of House Republicans because all of the Democrats on the Committee have voted against the Bill. House Republicans

If you should need any additional information or assistance to get this accomplished, please call the office at (215) 568-7500 or call toll free 866 Injury Law (866-465-8795).

We are also fighting Joint & Several Liability which passed the House and which is currently going to be addressed in the Pennsylvania Senate. The Senate Judiciary Committee has had hearings and a second round of hearings will be conducted on Thursday, May 19, 2011, at which time we have four speakers. Please also support us in this effort. Thank you.
