Pond Lehocky Associate Jason Kaner has authored an article published in the Pennsylvania Law Weekly discussing a recent Commonwealth Court decision finding that an injured NFL player was not a “seasonal worker” for the purpose of calculating his average weekly wage.
The case involved former Pittsburgh Steelers linebacker Anthony Trucks who signed a two-year contract but was injured in a preseason game and never played another snap for the team.
“Unlike previous decisions involving professional football players, the court decided they must now look at the facts and individual contract obligations of each player to determine if a seasonal employee relationship exists,” Kaner wrote.
“By determining Trucks was not a seasonal employee, the court has redefined the employer-employee relationship for NFL players in Pennsylvania,” he added.

Kaner joined Pond Lehocky last year as an associate, concentrating his practice on employment law and workers’ compensation matters. He graduated from the joint J.D./M.B.A. program at Villanova University Charles Widger School of Law and Villanova University School of Business.
