Case Law Update | Babu v. WCAB | PA Workers Comp Attorneys

October 15, 2014

Babu v. WCAB (Temple Continuing Care Center), __ A.3d __ (Pa. Cmwlth, No. 166 C.D. 2014, filed September 15, 2014).

At issue was the compensability of Ayurvedic medical care. The claimant received Ayurvedic treatment in India. The providers were not licensed to practice medicine in Pennsylvania and their services were not provided under the supervision of a licensed Pennsylvania health care provided. The WCJ found that the Ayurvedic treatment was not compensable.

The decision was upheld: services which are provided by a health care provider, not licensed or otherwise authorized by the Commonwealth to provide health services, are not reimbursable under the Act, even if the services had been prescribed by a health care provider.
