Pond Lehocky Obtains Exceptional Decision on Claim for Work-Related Stroke

Dave Stern of Pond Lehocky Proves Stroke to be a Work Injury

 

An overwhelming majority of workers’ compensation cases involve orthopedic injuries. However, David F. Stern, Partner of Pond Lehocky Stern Giordano, recently won workers’ compensation benefits for a client who had suffered a stroke while performing his duties. The stroke left the injured worker paralyzed on the left side of his body and unable to work.

 

Mr. Stern’s theory of the case was that the stroke resulted from the heavy work his client was performing in an excessively warm work environment. Despite the complexities of proving that the stroke was work-related, Mr. Stern stated: “I was convinced from a factual and medical standpoint that everything pointed to the work being the cause of the stroke.” Mr. Stern recovered both past and future wage loss benefits for his client, valued in excess of $1.1 million. Mr. Stern was also successful in holding the employer liable for payment of all medical bills associated with the stroke.
