Associate Attorney Daniel Santiago will be a special guest on La Mega 1310 AM’s El Terapia Immigrante this Sunday, February 8, 2015, from 7:30-8:30 a.m. He will explain immigrants’ and non-citizens’ rights to workers’ compensation in Pennsylvania as well as Social Security disability. Mr. Santiago hopes that listeners will take away a few key facts about workers’ compensation in case they become injured or are disabled.  

 

“I want people who listen in to know their respective rights when they have worked in the United States,” Santiago said. “I want people to know that there are systems in place that protect their interests as workers even if they are not considered citizens.” 

 

Some rules that are built into the law can help those who wish to file for workers’ compensation or Social Security disability. In Pennsylvania, an immigrant’s refusal to say whether he or she is legally authorized to live and work in the U.S. cannot be used him or her in a workers’ compensation dispute. Non-citizens who are permanent residents and have paid taxes into the Social Security system for the required amount of years are eligible for Social Security disability benefits, as are non-citizens who are veterans or active duty members of the U.S. military.
