Pond Lehocky Attorney Susan Nanes and Law Clerk Angela Lee discuss the question of “legal privileges” in The Legal Intelligencer

Attorney Susan Nanes collaborated with Pond Lehocky summer law clerk Angela Lee in the latest edition of Pennsylvania Law Weekly, where they discussed the nearly 200 year old legal institute of “privileges” in workers’ compensation cases. Privileges, or the right insurance adjusters exercise in order to withhold information pertaining to a workers’ compensation case, are still present in law practice today and further the interest of insurance companies while disenfranchising injured workers. 

 

“…We posit that these legally created mechanisms are still used today to protect powerful and moneyed employer and insurance interests to the disadvantage of, in our formulation, injured workers,” they wrote. Susan and Angela explain in the article how these privileges can be used to deny valid workers’ compensation claims and benefits for “no good reason.”
