In their latest Pennsylvania Law Weekly article, “Cross-Examination: The Greatest Engine for the Discovery of Truth,” Managing Partner Sam Pond and Associate Susan Nanes explain a trend in workers’ compensation that is hindering a fundamental legal principle – cross examination. Some employers and insurance companies are making key witnesses “untouchable” by preventing them from being questioned by the injured worker’s attorney. Preventing testimony that could add meaningful information to a case directly contradicts the Workers’ Compensation Act’s humanitarian goals, which include full, fair and free cross-examinations of such witnesses.
