A plumber began noticing problems with his right knee while performing his job duties. He came under medical care and was eventually forced to stop working in order to undergo surgery. Although he was later released to return to work in a light duty capacity, his employer of over 20 years refused to take him back unless he could work full duty. Instead, the employer laid the injured worker off. David Stern filed a Claim Petition on behalf of the injured worker which was assigned to a Philadelphia- area Workers’ Compensation Judge. Under the Pennsylvania Workers’ Compensation Act, an injured worker can receive workers’ compensation benefits for an injury which develops over a period of time and as a result of work activities. This holds true even if the injured worker has a pre-existing condition, so long as it is established that the injured worker’s work duties aggravated the condition. Mr. Stern negotiated a settlement in the amount of $115,000.00.
