A roofer fell off of a scaffolding while at work, injuring his left knee. The problems with the left knee caused the injured worker to limp, and he began to develop low back problems. After he underwent an independent medical evaluation, his employer filed a petition alleging that workers’ compensation benefits should be suspended because the injured worker was able to work in some capacity. David Stern filed a petition to expand description of the work injury to include the low back. Mr. Stern ultimately settled the case for $115,000.00, with medicals to remain open, to allow the injured worker to continue treatment at the employer’s expense.
