A machine operator injured himself after tripping over a machine and landing on his right hand. He reported the injury to the company doctor and was sent to a specialist. The specialist did not have any openings for a month, so the injured worker continued to work and treated with the company doctor in the interim. When he eventually saw the specialist, the injured worker learned that he had torn ligaments in his right hand needed surgery. He was immediately pulled out of work and began receiving workers’ compensation benefits. He was released to return back to work, and began performing light duty work. However, he had difficulties performing his light duty job since he it required him to use his right hand. David Stern met with the client and in reviewing the Notice of Compensation Payable, realized that the employer had failed to recognize the full extent of the worker’s injuries. While in litigation, Mr. Stern settled the case for $119,500.00.
