Workers’ Compensation Matters

Suffering a workplace injury can be a devastating loss for both individuals and their families. Navigating the often-complex legal process necessary to recover both physically and financially from such an event adds further difficulties to an already stressful situation.

At Pond Lehocky Giordano, we specialize in fighting for the rights of workers who have been negatively impacted by a work-related illness or injury, and it is our honor to help them recover to the greatest extent possible.

Workers’ Rights and Obligations

Alabama’s workers’ compensation law provides several benefits to a worker injured on the job. Remember, neither the employer nor their workers’ compensation insurance company have any obligation to advise you of all of your rights. Some of the benefits include:

Payment for all medical treatment incurred as a result of the accident/injury.

Remember, the injury must be reported and the medical treatment provided by an authorized medical provider.

If taken out of work due to the injury, the worker is entitled to 2/3 of their average weekly wages (AWW).

There is a formula used to determine this inclusion of benefits.

Permanent Partial or permanent total disability benefits depending on the severity of the injury.

Remember, in Alabama a court/judge cannot make the insurance company/employer pay you a lump sum settlement, but our lawyers are excellent at resolving cases for lump sum payments as opposed to long-term weekly payments.

Vocational benefits are due and owed if the employee is unable to return to their pre-injury job status as a result of their permanent injury and restrictions.

These benefits have value and are often overlooked by an injured worker not familiar with the law. Remember, neither the employer nor their workers’ compensation insurance carrier are required to advise you of your rights under the law.
