You also agree not to: scrape, crawl, harvest, or use automated means to access or collect data from the Site; reverse engineer, decompile, or attempt to derive the Site’s source code; interfere with, disable, or circumvent the Site’s security or access controls; or use the Site to distribute malware or to gain unauthorized access to any system, account, or data.
For public comments and testimonials only, you grant Pond Lehocky a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Site and our services. 12. Disclaimer of warranties and limitation of liability
EXCEPT AS EXPRESSLY STATED IN A WRITTEN AGREEMENT BETWEEN YOU AND POND LEHOCKY, ALL CONTENT AND SERVICES ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. POND LEHOCKY DOES NOT WARRANT THAT THE SITE OR ITS CONTENT WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, POND LEHOCKY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
13. Indemnification
You agree to indemnify and hold harmless Pond Lehocky and its employees, attorneys, and agents from third-party claims and reasonable attorneys’ fees arising from content you supply to the Site or your misuse of the Site, to the extent permitted by applicable law.
14. Arbitration and class-action waiver
Any dispute arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration, and not in court, except that either party may bring a claim in small-claims court. You and Pond Lehocky waive any right to participate in a class, collective, or representative action. This Section does not apply to any attorney-client relationship or engagement, which is governed by a separate written agreement.
15. Governing law and jurisdiction
These Terms and your use of the Site are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any legal action or proceeding relating to the Site shall be brought exclusively in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

If you believe content on the Site infringes your copyright, please send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent:

We will respond in accordance with the DMCA. In appropriate circumstances, we will terminate the access of users who are repeat infringers.
17. Client portal and app
For clients with an active engagement, we provide a secure client portal and mobile app to communicate about your matter and check case status. The portal and app are hosted by a third-party service provider and become available only after you have signed an engagement agreement; access is limited to current clients. You are responsible for keeping your login credentials confidential and for activity under your account, and you should notify us promptly of any unauthorized use. Your use of the portal or app is also governed by the service provider’s terms and privacy practices and by your engagement agreement; as to the portal and app, your engagement agreement controls over any conflicting provision of these Terms.
18. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, Consumer Health Data Privacy Policy, and Consent Terms, are the entire agreement between you and Pond Lehocky regarding the Site.
