Consumer Health Data Privacy Policy

Effective: August 31, 2026 | Last Updated: September 15, 2026

This Consumer Health Data Privacy Policy applies specifically to “consumer health data” and is provided under Washington’s My Health My Data Act and similar state laws. It supplements our general Privacy Policy. Pond Lehocky Giordano Inc. and its affiliates Pond Lehocky Giordano California LLP, Pond Lehocky Giordano Disability LLC, and Pond Lehocky Giordano LLP (together, “Pond Lehocky,” “we,” “us”) are responsible for the consumer health data described here.

We collect consumer health data in two ways. First, our website intake form collects limited consumer health data (the practice area and the description of your claim you choose to provide), which we collect to respond to your request and do not use or share for advertising or analytics. Second, we collect more detailed health information later, during client onboarding and intake, after you decide to become a client, with your signed, separate written consent. This policy explains how we handle that information.

1. Categories of consumer health data we collect

We collect consumer health data in two ways: (a) through our website intake form, limited to the practice area of your claim and the description of your claim you choose to provide; and (b) during client onboarding and intake, after you decide to become a client, which may include information about your past, present, or future physical or mental health condition, injuries, symptoms, diagnoses, treatment, and related information relevant to your legal matter.

2. Why we collect it

We use the consumer health data you submit through the website to respond to your request and evaluate how we may be able to help. We use consumer health data collected during onboarding to provide the legal services you engage us to perform, including to evaluate, develop, and pursue your matter.

3. Sources

We collect consumer health data directly from you (including through our website intake form), from persons you authorize to communicate with us on your behalf, and, where you authorize it, from your healthcare providers and other custodians of your records.

4. Categories of consumer health data we share

We share consumer health data only as needed for the purposes above and only with your consent. Where we share it, the categories may include the health-related information relevant to your matter.

5. Who we share it with

We may share consumer health data with:

  • Service providers and processors that host our systems and process communications on our behalf, including our client portal and app, under contracts that restrict their use of the data;
  • Among the Pond Lehocky entities identified at the top of this policy – Pond Lehocky Giordano Inc., Pond Lehocky Giordano California LLP, and Pond Lehocky Giordano Disability LLC – with your consent, as needed to handle your matter;
  • Other law firms to whom we refer your matter, or that assist with your representation, with your consent;
  • Healthcare providers, medical records custodians, and medical experts or examiners, to obtain, exchange, or evaluate records and information relevant to your matter, including under authorizations you sign, such as HIPAA authorization forms;
  • Courts, tribunals, and government agencies (such as workers’ compensation boards and the Social Security Administration), opposing parties and their counsel, and others involved in your matter, as necessary to pursue or defend your claim; and
  • Legal or regulatory recipients where required by law.

6. Consent

We collect consumer health data only with your consent, which you provide by voluntarily submitting it to us. Information you submit through the website intake form is collected to respond to the request you make and is never used or shared for advertising or analytics. We obtain separate, affirmative opt-in consent before sharing consumer health data except as necessary to provide a product or service you have requested or as otherwise permitted by law. We do not sell consumer health data without your valid, separate written authorization.

7. Your rights

You have the right to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data, and access that data (at least twice per year, free of charge);
  • Withdraw your consent to our collection and sharing of your consumer health data; and
  • Have your consumer health data deleted.

To exercise these rights, contact us at privacy@pondlehocky.com, or 215-568-7500. We will respond within 45 days.

8. Data security and access

We restrict access to consumer health data to those who need it for the purposes you consented to, and we maintain safeguards designed to protect it. We do not use geofencing around health care facilities to identify, track, or send messages to consumers regarding consumer health data.
