Statute of limitations

In Mississippi, the statute of limitations for most personal injury claims is three years from the date that the injury occurred.

Mississippi uses a “pure comparative negligence” rule when it comes to liability for a car accident, which means an injured party can recover damages in a car-accident-related lawsuit, but their award will be reduced according to their share of negligence.  

For example, if a driver was involved in an accident and found to be 20% at fault but won a judgment of $100,000, their total payment would be reduced by 20% to $80,000. Even if a driver is more at fault than the party they are suing, they can still collect damages from the other side.  

Animal Attacks 

Certain animal attack personal injuries, notably dog bites, are covered by state statutes. Some states, including Mississippi, have what is called a “one-bite rule,” which protects dog owners to some degree the first time their pet bites and injures a person if the animal had never shown a propensity for aggression or bitten anyone before.    

Compensation

After successfully settling their case or receiving an award in the form of a judgment, the injured party can be compensated for their suffering, including through ongoing payments for lifetime medical care if it is needed and payments to offset a reduction in their earning capacity caused by the injury.  

The same “pure comparative negligence” rule that applies in Mississippi car accident cases also applies to other personal injury cases. This means that the amount of compensation the injured party is entitled to will be reduced by an amount that is equal to their percentage of fault.
