PLG Partner Thomas Giordano Shares Disability Law Insights with Transplant Patients

That belief was exemplified recently when Thomas Giordano, a founding partner of the firm and an experienced disability attorney, volunteered his time and expertise to lead a webinar for the Gift of Life Howie’s House “Caregiver Lifeline Program.”

The Gift of Life Howie’s House is a Philadelphia-based nonprofit that offers a “home away from home” for organ transplant patients and their families traveling for care. Their Caregiver Lifeline Program provides education and support to families navigating the complexities of organ transplantation. Recognizing the challenges these families face, Mr. Giordano offered a clear and compassionate explanation of how Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) apply to transplant patients and their caregivers.

Breaking Down Disability Benefits for Transplant Patients

In the hour-long session, Mr. Giordano explained the key differences between SSDI and SSI – two distinct programs under the Social Security Administration – highlighting how each applies to individuals with severe medical conditions like those requiring or recovering from organ transplants.

Mr. Giordano emphasized that SSDI is based on work history and contributions to the Social Security system, while SSI is a need-based program designed for individuals with limited income and resources, regardless of work history. Many attendees were surprised to learn that they might qualify for one or even both programs, depending on their specific situation.

One of the most important takeaways from the session was the fact that organ transplant recipients are often automatically considered disabled for a defined period of time under Social Security guidelines, making them eligible for benefits – sometimes for up to three years post-transplant. For example, a lung transplant qualifies a patient as disabled for three years, while heart, liver, kidney, and stem cell transplants automatically qualify recipients for at least one year of benefits.

Why Medical Documentation Matters

Mr. Giordano repeatedly underscored the importance of medical documentation throughout the disability determination process. “I don’t care how good of a lawyer I think I am – if it’s not in your medical records, I can’t prove it,” he told participants. His guidance reminded attendees to be open and thorough when speaking with their physicians, as medical records are the primary evidence used by Social Security to approve or deny claims.

He also discussed how benefits can last beyond the automatic eligibility period if recipients continue to face complications, such as organ rejection, fatigue from medications, or frequent medical appointments. These details, if documented properly, can support a continued finding of disability.

Practical Tips and Encouragement

In addition to explaining eligibility rules, Mr. Giordano walked attendees through the SSDI/SSI application process, common pitfalls to avoid, and how to advocate for themselves. He also provided advice on appealing a denial, encouraging attendees not to give up if they are initially turned down. “The worst mistake you can make is to stop,” he advised. “Keep appealing. You could lose a lot of benefits by walking away.”

He closed the webinar with a message of hope and reassurance: disability benefits are not a life sentence or a scarlet letter, but rather a bridge to stability for those facing serious medical challenges. “It’s your money, and it’s there to support you until you’re ready to return to work,” he said.
