Retaliatory Discharge Following a Workers’ Comp Claim

On Tuesday, January 27, 2015, Partner Sam Pond and Associate Andrew Ruder’s latest article, “Retaliatory Discharge Following a Workers’ Comp Claim,” was published in Pennsylvania Law Weekly. In it, they discuss the various circumstances in which an employee may file a wrongful discharge claim in addition to a workers’ compensation one.
Like the pair’s previous two articles, this commentary highlights the humanitarian framework of the Pennsylvania Workers’ Compensation Act and stressed that it must be upheld during decisions. There is a growing trend of employers either threatening or discharging employees in retaliation for requesting workers’ compensation benefits, which directly violates the humanitarian framework of the Workers’ Compensation Act.
