FAQS Background

Can You Get Workers’ Compensation and Social Security Disability?

The answer is YES! While the rules differ from state to state, it is important to know that in some cases, there are offsets (reductions) against your Social Security disability benefits for workers’ compensation benefits you have received during the same time.

Despite the possibility of a reduction in benefits, in most cases it is still advisable to pursue Social Security disability if you are receiving workers’ compensation. This must be reviewed on a case-by-case basis by an appropriate attorney.

Generally speaking, Veterans Administration benefits and private pension benefits do not offset Social Security disability benefits.
