NJ Transit train hits tree, killing 1 and injuring 23

Pond Lehocky Giordano is investigating legal claims on behalf of individuals who were negatively impacted after a NJ Transit train collision on October 14th, 2024 in Burlington County, NJ.

On Monday morning, a tragic train accident on the NJ Transit River Line claimed the life of the train operator and left 23 passengers injured. The southbound light rail train collided with a fallen tree on the tracks near Roebling Station in Florence, Burlington County, at approximately 6:04am, according to NJ Transit officials.

23 of the 42 passengers aboard sustained injuries. Thanks to a swift response from emergency personnel, these injuries were not considered life-threatening, but passengers were transported to local hospitals for further treatment. NJ Transit initially reported varying numbers of injured passengers as investigators continued to assess the scene throughout the morning.

In the wake of the accident, NJ Transit suspended all light rail services between Trenton and Florence. Commuters were provided with substitute bus services as investigators worked to clear the scene and determine how the tree had ended up on the tracks in the first place. The incident also led to the closure of a portion of Route 130 south in Burlington Township, further complicating travel for local residents.

Investigations into the train accident are ongoing

Governor Phil Murphy expressed his condolences and provided an update via social media, stating: “I have been briefed on an accident on NJ Transit River Line Light Rail earlier today in which the light rail struck a tree on the tracks, leading to the death of the train operator and injuring passengers. An investigation is underway. Our prayers are with all affected by this tragic incident.”

While investigators continue their work, questions remain about the cause of the fallen tree and whether preventative measures could have averted the accident. As with all train accidents, determining the root cause will be critical to ensuring the future safety of NJ Transit passengers and operators.

This incident follows another NJ Transit light rail accident that occurred just days earlier. On Thursday, October 10th, a light rail train struck a truck in Burlington Township, injuring four passengers and the operator.

What to do if you’ve been impacted by a train accident

In the aftermath of such accidents, passengers and their families are often left facing not only physical and emotional trauma but also confusion and uncertainty about their legal rights. Many may be unaware of the options available to them or feel overwhelmed by the prospect of dealing with insurance companies, medical bills, and legal proceedings. Understanding your rights in these situations is crucial.

If you or a loved one has been injured in a train accident, you may be entitled to compensation that goes beyond just covering medical bills. This compensation can include reimbursement for lost wages if you are unable to work due to your injuries, recovery of future earning potential in cases of long-term disability, and compensation for the emotional distress caused by the accident. The law recognizes that the impact of such incidents extends far beyond the immediate physical injuries, often affecting your quality of life, your finances, and your emotional well-being.

How a train accident lawyer can help with your claim

Navigating the legal landscape following a train accident can be complex. Various parties may be liable for the accident, including the train operator, the transit company, or even third parties like maintenance crews or contractors responsible for track safety. Determining who is at fault and proving negligence requires thorough investigation and an in-depth understanding of both personal injury law and the specific regulations governing train operations.

The expert legal team at Pond Lehocky Giordano has a proven track record in handling train accident claims. We understand the urgency and sensitivity of these situations and are committed to helping you through this challenging time. From gathering evidence, consulting with accident reconstruction experts, and negotiating with insurance companies to representing you in court if necessary, we are prepared to fight for your right to full and fair compensation.

Additionally, train accidents may involve government entities or public transportation authorities, which means special legal procedures and deadlines may apply. For example, claims involving public transit systems often have shorter time frames within which you must file a notice of claim. Missing these deadlines could jeopardize your ability to recover damages. This is why it’s important to consult an attorney as soon as possible after the accident.
